A reporter asked: On May 30, the Ministry of Commerce, the General Administration of Customs, and the Equipment Development Department of the Central Military Commission jointly issued an announcement on the implementation of export controls on relevant items. What are China's considerations for issuing export control policies this time?
The spokesman said that on May 30, the Ministry of Commerce, the General Administration of Customs, and the Equipment Development Department of the Central Military Commission jointly issued an announcement to implement export controls on some specific molds and other equipment, software, and technologies in the aerospace and shipbuilding fields, as well as ultra-high molecular weight polyethylene fiber-related items.
The above policy will be officially implemented from July 1.
It is an international practice to implement export control on specific molds, special fiber materials and other related items. China has learned from international practices and implemented export controls on relevant items according to its own needs, with the aim of better safeguarding national security and fulfilling international obligations such as non-proliferation. These policies are not specific to any specific country or region. If the export meets the relevant regulations, it will be licensed. The Chinese government is committed to maintaining world peace and stability in the surrounding region, ensuring the security of global industrial and supply chains, and promoting the development of compliant trade. At the same time, we oppose the use of controlled items from China by any country or region to engage in activities that harm China's national sovereignty, security and development interests.
The full text of the announcement is as follows:
In accordance with the relevant provisions of the Export Control Law of the People's Republic of China, the Foreign Trade Law of the People's Republic of China, and the Customs Law of the People's Republic of China, in order to safeguard national security and interests, and fulfill international obligations such as non-proliferation, with the approval of the State Council and the Central Military Commission, it has been decided to implement export controls on the following items. The relevant matters are announced as follows:
1. Items that meet the following characteristics shall not be exported without permission:
(1) Aerospace structural parts and engine manufacturing related equipment, software and technology.
1. Tools, molds, fixtures and other process equipment specially designed for the superplastic forming/diffusion connection of titanium, aluminum and their alloys for the manufacture of any of the following items (refer to the customs commodity number: 8203200010, 8204110010, 8204120010, 8205400010, 8205900010, 8206000010, 8480419010, 7326901910):
(4) Specially designed components for aero engines or aerospace engines.
2. Software specially designed or improved for the development, production or use of the items listed in 1 above.
3. The technology and its carrier used for the research and development, production or use of the items listed in 1 above, including design drawings, process specifications, process parameters, processing procedures, simulation data, etc.
Technical Notes:
Superplastic forming refers to the forming process of using the ultra-high elongation and superplasticity of superplastic metal materials under specific temperature and strain rate conditions to achieve forming processing as the formed blank in the mold cavity to obtain various required shapes.
Diffusion connection refers to the forming process in which the surfaces of two materials in contact with each other are close to each other under the action of temperature and pressure, and local plastic deformation occurs, and the atoms diffuse each other, forming a diffusion layer at the interface contact, so as to achieve reliable connection.
(2) Gas turbine engine/gas turbine manufacturing related equipment, software and technology.
1. Directional crystal or single crystal casting equipment for the manufacture of superalloys required for gas turbine engines/gas turbine blades, directors and other turbine configuration components (refer to customs commodity numbers: 8454301010, 8454309010).
2. Precision casting intermediate products (including ceramic cores, wax mold modules, and shells) specially designed for the manufacture of gas turbine engine/gas turbine blades, guides, casings and other turbine configuration components, as well as tools, molds, fixtures and other process equipment specially designed for the manufacture of the above-mentioned intermediate products (refer to customs commodity numbers: 6903100010, 6903200010, 6903900010, 6909110010, 6909120010, 6909190010,8480490010,8205900020,8428909030,8480600010,7326901920,7616991020,9031809081).
3. Tools, molds, fixtures and other process equipment specially designed for the solid connection of discs of high-temperature alloys, titanium alloys or intermetallic compounds of gas turbine engines/gas turbines (refer to customs commodity numbers: 8205900030, 6804219010, 6804229010, 8207201010, 8207209010, 8207300030, 8480419020, 8466200010, 7326901930,9031809082).
4. Software specially designed or improved for the research and development, production or use of the items listed in 1, 2 and 3 above.
5. The technology and its carrier used for R&D, production or use of the items listed in 1, 2 and 3 above, including design drawings, process specifications, process parameters, processing procedures, simulation data, etc.
Technical Notes:
Superalloy refers to nickel-based alloy, cobalt-based alloy or iron-based alloy containing refractory metal, which can withstand complex stress under oxidation and hot corrosion conditions of 600 degrees Celsius (°C) and above, still have good comprehensive properties, and can work reliably for a long time.
(3) Spacesuit window related equipment, software, and technology.
1. Specially designed molds for the manufacture of spacesuit windows (refer to customs commodity number: 8480719020).
2. Software specially designed or improved for the development, production or use of the items listed in 1 above.
3. The technology and its carrier used for the research and development, production or use of the items listed in 1 above, including design drawings, process specifications, process parameters, processing procedures, simulation data, etc.
(4) Ultra-high molecular weight polyethylene fiber related items.
1. Ultra-high molecular weight polyethylene fiber with a breaking strength of ≥ 40cN/dtex, an initial modulus of ≥1600cN/dtex and untwisted (refer to customs commodity codes: 5402491010, 5501900010, 5503909010).
2. The soft non-weft fabric laminate made of ultra-high molecular weight polyethylene fiber (without pressure) is resistant to 1.1g standard simulated fragments (17 grains of simulated fragments FSP) V50≥700m/s (tested in accordance with GJB4300A-2012 Appendix B "Ballistic Limit V50 Test Method" under the condition of areal ≤density of 5.3kg/m2) (refer to customs commodity number: 5806409010).
3. The technology and carrier for the production of the items listed in 1 and 2 above, including design drawings, process specifications, process parameters, processing procedures, simulation data, etc.

The exporter shall go through the export licensing formalities in accordance with the relevant regulations, submit an application to the Ministry of Commerce through the provincial-level competent department of commerce, fill in the application form for the export of dual-use items and technologies, and submit the following documents:
3. The Ministry of Commerce shall conduct an examination from the date of receipt of the export application documents, or jointly with the relevant departments, and make a decision on whether to approve or disapprove the license within the statutory time limit.
The Ministry of Commerce, in conjunction with relevant departments, shall report to the State Council for approval for the export of items listed in this announcement that have a significant impact on national security.
4. If the license is approved after examination, the Ministry of Commerce shall issue an export license for dual-use items and technologies (hereinafter referred to as the export license).
5. The procedures for applying for and issuing export licenses, handling of special circumstances, and the retention period of documents and materials shall be implemented in accordance with the relevant provisions of Decree No. 29 of 2005 of the Ministry of Commerce and the General Administration of Customs (Administrative Measures for the Import and Export Licenses of Dual-Use Items and Technologies).
6. Exporters shall issue export licenses to the Customs, go through customs formalities in accordance with the provisions of the Customs Law of the People's Republic of China, and accept customs supervision. The Customs shall go through the inspection and release procedures with the export license issued by the Ministry of Commerce.
7. Where an exporter exports without permission, exports beyond the scope of the license, or commits other illegal circumstances, the Ministry of Commerce or the Customs and other departments shall impose administrative penalties in accordance with the provisions of relevant laws and regulations. where a crime is constituted, criminal responsibility is pursued in accordance with law.
8. The export of bulletproof helmets, body armor, bulletproof inserts, bulletproof plates (bulletproof armor plates, composite bulletproof plates) and other protective equipment made of ultra-high molecular weight polyethylene fibers, as well as ultra-high molecular weight polyethylene fiber non-woven cloth target plates used to make protective equipment, shall be carried out in accordance with the relevant provisions of the "Regulations of the People's Republic of China on the Administration of the Export of Military Products".
9. This announcement will be officially implemented from July 1, 2024.
